Terms of Service

Jumboshack is a monitoring and data product currently offered in a private beta. Please read these Terms carefully — by creating an account or sending data to Jumboshack, you agree to them.

1. Who we are

“Jumboshack,” “we,” “us,” and “our” refer to Jumboshack, the operator of the Jumboshack website and the dashboard and data services available at jumboshack.com and its subdomains (the “Service”). “You” means the person or entity using the Service.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the information you provide, for keeping your login credentials and device tokens secure, and for all activity under your account. Enable two-factor authentication where available. Notify us promptly of any unauthorized use. The Service is currently invite-only; access may be granted or revoked at our discretion.

3. Your data and content

You own the data you send us. By using the Service, you grant Jumboshack a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your data solely as needed to operate and provide the Service to you (including generating your dashboards, history, and reports), and to create aggregated and de-identified statistics that do not identify you or your household and that we may use to operate, secure, and improve the Service. We do not sell your personal data. You are responsible for having the right to send us any data you transmit.

4. Your hardware and equipment

The Service is a read-only monitoring product. You are solely responsible for your own hardware (including any Raspberry Pi, adapters, sensors, and HVAC or other equipment), its installation, configuration, safety, and maintenance. Jumboshack does not control, command, or modify your equipment, and is not responsible for your equipment or for any decisions you make based on the Service.

5. Acceptable use

You agree not to: (a) use the Service unlawfully or to infringe others’ rights; (b) send data you don’t have the right to send; (c) attempt to access accounts or data that aren’t yours; (d) interfere with, overload, or circumvent the Service’s security, rate limits, or access controls; (e) reverse engineer, resell, or redistribute the Service except as expressly permitted; or (f) use the Service to build a competing product.

6. Beta service; availability

The Service is provided in beta and may change, be interrupted, or be discontinued at any time. Features may be added or removed, and data may be lost. Do not rely on the Service as your sole record or for any safety-critical, medical, or emergency purpose. We aim for accuracy but do not guarantee that readings, calculations, or availability are error-free.

7. Fees

The Service is currently free during the beta. We may introduce paid plans and change pricing in the future; we will provide notice before charging you, and paid features will be identified as such.

8. Intellectual property

The Service, including its software, design, text, graphics, and the “Jumboshack” name and logo, is owned by Jumboshack and protected by intellectual-property laws. Except for the rights expressly granted to you to use the Service, no rights are transferred. Product names and trademarks of others (including WaterFurnace and Raspberry Pi) belong to their respective owners; Jumboshack is independent and not affiliated with them.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Upon termination, your right to use the Service ends; sections that by their nature should survive (including data, IP, disclaimers, and liability) will survive.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR PRESERVED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUMBOSHACK AND ITS PRINCIPALS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50.

12. Indemnification

You agree to indemnify and hold harmless Jumboshack from claims, damages, and expenses (including reasonable legal fees) arising from your data, your equipment, your use of the Service, or your violation of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of [STATE], United States, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction of the state and federal courts located there, except where prohibited by law.
